Summary:

This item is for the Board of Education (Board) to consider adopting the Resolution Approving and Adopting School Facility Fee Justification Report for Residential, Commercial and Industrial Development, and Authorizing Increase in Statutory Level 1 Developer Fee Rates (Resolution) in accordance with applicable laws. The maximum Level 1 developer fees that a school district may charge are set by statute. Statutory Level 1 developer fee rates are set by the State Allocation Board (SAB) every two years on even years. In January 2024, the SAB increased the maximum allowable Level 1 developer fee rates on residential development from $4.79 to $5.17 per square foot of assessable space, and on commercial/industrial development from $0.78 to $0.84 per square foot of chargeable covered and enclosed space.
In order for the District to charge the new rate, a fee justification study is required to establish that (i) a nexus exists between new development in a school district and the need for school facilities, and (ii) the amount of the Level 1 developer fees imposed on each type of development. District’s fee consultant, School Facility Consultants, prepared the School Facility Fee Justification Report for Residential, Commercial & Industrial Development Projects, dated May 2025 (Fee Justification Report), justifying the District’s levy of the maximum Level 1 developer fee rates, as further detailed in the Fee Justification Report.
Pursuant to Government Code section 66016(a), prior to the District levying a new fee or approving an increase in an existing fee, the Board must hold at least one open and public hearing, during a regularly scheduled meeting, at which oral or written presentations may be made by the public. The Board held the public hearing on this date hereof, during this regular Board meeting, and provided opportunity to the public to make oral and written presentations on the District’s proposed Fee Justification Report. Pursuant to Government Code section 66016(b), fee increases must be adopted via resolution. The District may begin to impose the new Level 1 developer fee rates 60 days from the date of the Board’s adoption of the Resolution.
If the Resolution is adopted by the Board, the District may increase its developer fee rates, effective August 2, 2025, to $5.17 per square foot of assessable space for residential development, and to $0.84 per square foot of chargeable covered and enclosed space for commercial/industrial development.

Statutory school fees collected for residential development will rise from the current rate of $3.48 per square foot to $5.17 per square foot and commercial/industrial development will rise from $.56 per square foot to $.84 per square foot.
